Abolish Unlawful Incarceration

This petition is to put into place the Illinois statute 730 ILCS 5/5-8a Electronic Home Monitoring. This statute states that EHM counts as TIME SERVED in the state of Illinois. Put an end to ignorance of our judges and stop innocent men and women from being sentenced to prison. This is on behalf of Jason E. Smith, who was unlawfully incarcerated on July 11th, 2013. He was sentenced to 3 years at 50% in October of 2011 for aggravated DUI. He served 4 months in prison and was released by Grundy County Judge Lance R. Peterson in February of 2012. From February 2012 to July 11th, 2013, Jason was placed on Electronic Home Monitoring. The same judge sent him BACK to prison because he stated EHM does NOT count as time served. This is incorrect and it is a VIOLATION of Jason's civil rights
