Accept any public statement by a senate leader to not allow a hearing for a supreme court nominee as advice and consent

If a Senate Leader in the decision chain to advise and consent to the confirmation of a supreme court justice nominee states that he or she will not allow the consideration of a nominee during President Obama's term that President Obama must recognize that the Senate's refusal to consider itself is advise and consent and proceed with installing the nominee into the supreme court.
