Enact legislation that would add a provision to all federal contracts that would require contractors to testisfy before Congress if requested, and disallow agencies from adding any contractual obligations that would prevent any contractor from disclosing any aspect of performance under that contract. In recent healthcare.gov testimony, several contractors would not disclose facts without prior CMS approval due to contract requirements that disallowed disclosure. Congress is ultimately responsible for the performance of all contracts being the duly electred representatives of the people, and therefore should have unfettered access to performance and handling information without prior approval from a federal agency.
