Massachusetts Supreme Judicial Court ruled Wednesday, March 5, that secretly photographing under clothes (upskirting) is legal. This surreptitious invasion of privacy challenges the expectation of privacy and human dignity that should be afforded a man or woman.
Taking a picture of a person's privates or underwear in public, regardless if they are wearing a dress or skirt, is disgusting.
In the words of Suffolk County District Attorney Daniel Conley: "If the statute as written doesn't protect that privacy, then I'm urging the Legislature to act rapidly and adjust it so it does."
As a constitutional scholar, as the leader of the free world and as a husband and father, please lend your voice to encourage quick action by the Commonwealth of Massachusetts to fix this.
