Citizens granted an expungement or vacation of criminal charges of a non-violent, non-sexual nature should be entitled to have all records of arrest and criminal history removed from the FBI's NCIC database.
This action should be taken immediately upon the expungement, sealing, or vacation of criminal charges by state, local, or federal agencies.
Currently, only local and state records can be expunged, sealed, or vacated, while the NCIC maintains a permanent record of offenses for access by the federal government, local law enforcement, and other agencies. Current practice does not allow citizens to alter or remove NCIC records, even after "paying one's debt to society," often barring them from gainful employment, military service, or other opportunities to be productive citizens.
