Buy classifying Marijuana a Schedule I substance, the Individual States -- and its citizens -- are unable to regulate the substance in any definitive way. It is clear that Marijuana has some value for medical use. Failing to acknowledge this simple fact is causing several, significant problems.
The first and foremost, states who have passed laws and propositions concerning the decriminalization of Marijuana have been left holding a very heavy ball. States are left with the laundry list of conflicting considerations. One would be a potential tax revenue generator surely going to draw in 100s of millions a year, and the other: engaging in a federal criminal offense -- as Conspiracy to distribute Marijuana is. We can't selectively prosecute now!
States should be guided, not restrained!
