Dr. Aznarez is a molecular biologist developing treatments for genetic diseases. She is married to a US citizen and resides legally in New York. The Department of State and USCIS are denying her the opportunity to become a permanent resident even though her spouse wishes to sponsor her for a green card. Because Dr. Aznarez entered the US as an exchange visitor, USCIS is insisting that Dr. Aznarez must first return to her country of citizenship (Uruguay), while the State Department is insisting that she must return to her country of last residence (Canada). Dr. Aznarez has no legal basis to live in Canada as her permanent resident status there has lapsed, and the Uruguayan Embassy has affirmed that it has no objection to her staying in the US. This is an impossible Catch 22. Please help.
