CMS has ordered the state of Virginia to reject FOIA requests for records of investigations into hospital complaints, specifically complaints against Inova Fairfax Hospital, after families of deceased patients found critical differences between the original reports and the reports given to CMS. (See this Miami Herald story: http://www.miamiherald.com/2013/01/23/3196815/va-agency-pulls-public-acc...) This move prevents survivors from having access to information they need in making insurance claims, filing malpractice suits, and other actions. At least three Medicare patients have died within the last 18 months from apparent patient dumping by just one hospital; if this happens again, the families will have less ability to protest.
