Josh Fox was arrested for attempting to record a public hearing on fracking (hydraulic fracturing) from the House Subcommittee on Energy and Environment.
Even according to an extreme view of the rules regarding recording public committee sessions, confiscation of the camera or ensuring it was not recording, would have been a proper course.
Public government hearings should be public, and anyone attending should be able to record them, so long as this does not cause an unreasonable disruption to the hearing. This is at the very heart of Freedom of the Press as guaranteed by the First Amendment.
