Small high-tech startup companies are great for boosting the economy and creating American jobs. There are a lot of talented foreigners working in high-tech fields with enormous entrepreneurial potential. Unfortunately, it is very difficult for them to create businesses legally! An entrepreneur cannot get either a green-card, or an H1B visa, or a TN visa, for a company that she owns, without going into serious legal grey areas. (For example, Indian employee of Microsoft on H1B visa creating a small website on the side in spare time may be in serious violation of INS rules). Ironically, the very immigration laws designed to protect American jobs are stifling innovation and job creation. Proposed "Startup Visa" legislation is not good enough as it applies only to companies already funded.
