Judicial clerks do not get retirement-pension credit. This could be fixed if clerks could use Form SF3108 to obtain service credit retroactively. SF3108 allows federal employees to pay into the retirement system to receive credit for their years of government service when such earned pension credit was not granted initially. Unfortunately, under current rules, judicial clerks cannot use SF3108 because they work under one-year contracts (rather than “at will” or 366-day contracts). This 365- versus 366-day distinction can be removed with your help.
