Currently there are many families with mixed status (U.S. citizen, non-resident, undocumented, LPR, etc)This petition would allow for an individual married to a U.S. Citizen the opportunity to adjust his/her status to gain legal status without having the undocumented/non-resident return to their country of origin. It would allow those that do not have criminal records (minor offenses to be excluded) the opportunity to remain in the U.S. and have the opportunity to have the legal status as a legal permanent resident first, and then the opportunity to apply for U.S. Citizenship. This petition would help the many families that have both a U.S. Citizen spouse and a non-resident or undocumented spouse. At present, marriage does not grant an undocumented person the opportunity to become a LPR
