At present a work-visa (H1 or L1 Visa) professional is required to have a Green Card sponsoring employer till adjustment of status is filed. This petition requests that work-visa holders having more than 10 years of work-experience in USA (H1, L1, or a combination) are allowed to own the Green Card process without requiring a sponsoring employer.
Implications for worker:
1. can maintain his/her green card process making him less dependent on employer and more competitive in industry, provided he/she can maintain legal work status after 10 years.
3. can change employment freely and will only need labor clearance but no new I-140 or Green Card application.
We request congress to improve Green Card process for Work-Visa holders to improve competitiveness and to retain talent/expertise.
