California has laws that make filing a medical malpractice lawsuit so expensive and settlements so limited that individuals that have been seriously harmed by medical malpractice are unable to file. Physicians therefore do not face consequences and victims are not able to obtain compensation. This seriously affects quality of care. With the deaths from medical malpractice at 100,000 per year or above this problem needs to be addressed to hold medical practitioners accountable for the harm done to patients. The Value Based Pricing of the Affordable Care Act does address this problem in four areas of medical practice, but poor practitioners are not held accountable for harm to individual patients.
