The fact that the National Labor Relations Act does not grant authority to the National Labor Relations Board to award damages beyond backpay and reinstatement renders the Act and its administering agency powerless in the face of law breaking employers. This Administration must prioritize moving Congress to either amend the NLRA to grant the NLRB the power to assess compensatory and punitive damages or amend Title VII of the Civil Rights Act to include concerted activity as a civil right. Otherwise, American workers will continue to flounder without an adequate enforcement mechanism to level the playing field as was the original intent of the Act.
