Section 1031 of the NDAA endangers the civil liberties of American citizens. It allows citizens and non-citizens to be detained for an indefinite period of time. It violates several amendments (1, 4, 5, 14) under the guise of combating terrorism.
While section 1032 addresses the issue for the most part, it is ridiculously vague. A loophole could be exploited so that American citizens could be detained indefinitely by non-military agencies.
These two sections are unconstitutional, therefore section 1031 and 1032 should be amended to make sure non-military agencies cannot detain American citizens on suspicion of terrorism. If amendment is not possible, then both sections should be repealed.
