Amend the Sections in the Patient Protection and Affordable Care Act (Obamacare) that Discriminate Against Tobacco Users

The "PPACA" (Obamacare) has four variables that decide how much an insurance company can charge for premiums. In "SEC. 2701. FAIR HEALTH INSURANCE PREMIUMS", item "(a)" clearly states "PROHIBITING DISCRIMINATORY PREMIUM RATES". The four variables;
(i) individual/family plan
(ii) geographical location
(iii) age
(iv) tobacco use
Tobacco users can then be charged up to an additional 50% on premium rates. This is a blatant discrimination against a group of people suffering from a legal form of drug addiction. The NIH, a government agency, lists nicotine addiction as a form of substance abuse. Why then are tobacco users being singled out unfairly? No other preventable conditions are listed (obesity, alchohol/drug abuse, STD's, etc.). Any addiction lawfully falls under pre-existing conditions.
