Amend Title II of the Civil Rights Act of 1964 to Include Sexual Orientation and Gender Identity

Title II of The Civil Rights Act of 1964 outlawed discrimination based on race, color, religion, sex, or national origin in places of public accommodation.

The constitutionality of the Act was established in the case Heart of Atlanta Motel, Inc. v. United States in which the Supreme Court of the US held that Congress has the power to regulate local incidents of commerce under the Commerce Clause and that places of public accommodation had no right to select guests as they saw fit, free from governmental regulation.

As a result of the recent progression of LGBT+ rights in the US, from cases such as US v. Windsor and Obergefell v. Hodges, and recent legislation passed in NC and MS, it is time to include sexual orientation and gender identity in Title II of the Civil Rights Act of 1964.
