(P.L. 99-335) created a retirement program for congress that made a congressman eligible for benefits starting at age 62 if he/she served only 5 years of service, at age 50 for 20 years of service, and at any age after 25 years of service. 66% of the incoming Senate for 2012 and 48% of the incoming House of Representatives meet this requirement of age 62 at onset of service making likely a large liability for following pensions. As many Americans are forced to contribute through 401 (k) or 403 (b) plans instead of a pension plan, so should congress follow suit and be responsible for their own retirement plans through self-contributing. As such, they should also be subject to any laws that they pass to enforce on the American people without exemption.
