Appoint Merrick Garland directly to the Supreme Court as the US Senate has waived its right to consent by not acting.

President Barack Obama nominated Merrick Garland to the Supreme Court of the United States on March 16, 2016. The United States Senate has waived its right to give advice and consent on this nomination by allowing the passage of more than 90 days without taking up discussion and voting on same.

A waiver is an intentional relinquishment or abandonment of a known right or privilege. The Supreme Court has said: No procedural principle is more familiar to this Court than that a constitutional right may be forfeited in criminal as well as civil cases by the failure to make timely assertion of the right before a tribunal having jurisdiction to determine it.

We ask that President Obama exercise his appointment power by immediately naming Merrick Garland to the United States Supreme Court.
