The Constitution states that the president “shall nominate, and by and with the Advice and Consent of the Senate, shall appoint . . . Judges of the supreme Court, and all other Officers of the United States.” The obstructionism of the current Senate is in direct conflict with the Constitution. By making the decision not to act, the Senate is waiving its right to provide advice and consent. Therefore, we the people, request that President Obama give the Senate a deadline to act before they waive their right to participate. We then ask the president to exercise his appointment power by naming Garland to the Supreme Court.
