There is sound Constitutional basis to conclude that if the Senate hasn't agreed to a vote, or even to meet with Garland by the time it goes into recess, it has waived its right to advise the President and consent to or reject the President's nominee. Therefore, the President should appoint Garland to the Court between Jan. 1 and Jan. 20 of 2017.
