Justice John Roberts should swear in Merrick Garland to the Supreme Court. "Article II, Section 2: “[The President] shall nominate, and by and with the Advice and Consent of the Senate, shall appoint…Judges of the Supreme Court.”
We have three coequal branches of government, and the Senate is half of the legislative branch. By refusing to do its constitutional duty to hold hearings and vote on President Obama's nominee, the Senate is preventing the executive and judicial branches from doing their duty. This is a constitutional crisis and could set a dangerous precedent, whenever the President and the Senate are of different political parties.
