It is clear that the Senate will block any effort to appoint a justice before the election. There are too many important cases before the court to allow them to be decided by a less than fully functional court. These cases include Civil rights, voting rights, Women's rights, and immigration cases that could affect future generations of Americans. The President is constitutionally empowered to make a recess appointment, and he should exercise that right.
