The President of the United States is able to appoint a Supreme Court Justice during a recess of the Senate. The Senate is presently on recess and will be until Tuesday. Monday is President's day. In the face of the stated intent to deny approval of ANY appointment of a Supreme Court Justice to replace the recently deceased Justice, President Obama should appoint a new Justice on Monday, January 15, 2016.
