Recent and tragic mass-shootings have made it more clear than ever that there is a need for real and effective gun control in this country. Yet, many sensible, effective laws which could be passed to stem the tide would soon be struck down by courts due to Justice Scalia's activist opinion in DC v. Heller creating an individual right to own firearms. Despite regarding himself a "textualist", Justice Scalia completely disregarded the preamble to the 2nd Amendment choosing instead to manufacture an individual right out of thin air and also to hold that common-sense restrictions based on the compelling interest of limiting gun violence violated this right he had just created. As many justices come near retirement, it is essential that their replacements be committed to overrule Heller.
