Justice Scalia must recuse himself when the DOMA/Prop 8 cases come before the Supreme Court in 2013.
Justice Scalia has shown his inherent bias toward gays in the past. First, in Lawrence v. Texas he compared homosexuality to bestiality and incest. More recently at Princeton, Scalia claimed that if one could not be morally opposed to homosexuality, one could not be morally opposed to anything, such as murder.
The law (28 U.S.C. § 455) requires that a judge must disqualify him or herself in any proceeding in which s/he is unable to remain impartial.
The law must be the reason why a case is decided in a certain way, and Justice Scalia cannot objectively use the law with such a predominant bias.
