President Barack Obama is and was the current president at the time of the most recent Supreme Court vacancy. It is President Obama's constitutional right and responsibility to fill that vacancy. The Senate has been derelict in their duty to Advise the president and has tried to take away his right as the people's chosen executive to seat a Supreme Court justice. President Obama should sue Congress through the Supreme Court to fulfill his constitutional duty before the next president is sworn in.
