Patents on living organisms should be illegal. A living organism and the spread of its genes through reproduction means that, once exposed to a new environment or eco system, it is likely to cross breed with like organisms.
It is because of this that corporations like Monsanto can sue and close down privately operated farms on the claims that the farmers are violating patents. Small farmers cannot control wind direction, nor can they wall their crops off sufficiently to avoid cross pollination and crop contamination.
It is akin to a breeder's dog jumping your fence and mating with your dog only to have the breeder sue you for all that you are worth when the puppies arive. It isn't your fault that their dog was on the loose.
And what right do we have as humans to patent a living thing?
