The Deceleration of Independence already states that all men have a right to "life, liberty, and the pursuit of happiness." That is already taken away when people are incarcerated. The constitution also states that "no cruel and unusual punishment" shall be issued. The death penalty is as cruel as it gets, taking the life away from a human being.
