My employer should have nothing to do with what activities I engage in outside the workplace. An individual's job performance should be judged on their actions and the content of their character, not some arbitrary, meaningless test that amounts to nothing more than legally sanctioned job discrimination. When hiring employees, employers can not discriminate by asking if someone is an alcoholic or of a particular religion, how is pre-emp drug testing any different? How is it not discrimination to ask me to provide a sample from my body and then judging it's quality for a job?
