The US Department of Transportation (USDOT) has proposed to amend 14 CFR Part 252 "to define smoking as the smoking of tobacco products or use of electronic cigarettes that are designed to deliver nicotine or other substances to a user in the form of a vapor" (Department of Transportation, DOT-OST-2011-0044-0003).
This proposed rule threatens to restrict the use of a product which the U.S. Court of Appeals for the D.C. Circuit found (in Sottera, Inc. v. FDA) "that e-cigarettes and other nicotine-containing products are not drugs or devices unless they are marketed for therapeutic purposes."
This petition seeks to block the USDOT proposed rule on the grounds that insufficient studies exist regarding the health impact on third parties from electronic cigarette vapor. Sign now!
