As the law is currently misinterpreted it nearly impossible for a small inventor or creator to successful bring new ideas to market because, large number of patients are held by firms with no intent of ever bringing them to market. Then as soon as someone really invents a product similar to their their pie in the sky description, they use lawfare' methods to extort millions in payoffs.
Also fair use laws, need to be made clearer to allow original creators more leeway with derivative works, like fanfiction.
The Constitution is very clear that this is not the intent of patents or copyrights. The laws need to be modified to ENCOURAGE not DISCOURAGE new ideas, and old ideas MUST make the transition to public domain in a reasonable time scale to allow derivative works to be developed.
