Employment based (EB) immigration has 5 categories namely EB1-EB5. EB2/EB3 both require Labor market TEST which ensures there are no Americans to take up the job candidate is being hired for. EB2/EB3 involve 10+ years of wait for citizens of India to get Permanent residency. EB1C (Multi-National Executive) loophole doesn't require PERM process & used by companies based in USA & INDIA for many mid level roles such as Lead / Manager etc. These jobs are PROJECT/SERVICE DELIVERY & NON-EXECUTIVE in nature, Since there's no way to independently VERIFY one is EXECUTIVE or not, there's rampant fraud of EB1C abuse which consumes all visas & makes EB2/EB3 India employee & families to wait for 10-20 years. We request US congress to initiate inquiry & pause EB1C filing for all but C-level executives.
