U.S. Court of Appeals for the D.C. Circuit ruled Obama ignored the Senate’s “advise and consent” role by making three appointments to the labor board while the Senate was in session. Obama's spokesman Jay Carney has essentially indicated that the White House will ignore the order, as has the NLRB.
The court ruled the actions were invalid from its inception, therefore any actions taken since the unconstitutional appointments must be invalidated and the current Board disbanded.
