certify to the Supreme Court the question of the Senate's refusal to vote on a nominee.

We ask that the President, through the officer of the Solicitor General, certify to the Supreme Court the question of whether the Senate may constitutionally refuse to act upon the President's nomination of a new Associate Justice. We make this request in the conviction that for any branch of government to decline to perform, in a timely manner, its mandated functions is both illegal and morally wrong.
