NDAA for 2008 entitled service members who were medically separated with a 20% or less rating to potential full retirement benefits (typically awarded when a member is rated at 30%+). The NDAA states those medically discharged between 9/11/2001 and 12/31/2009 can be medically retired if their VA rating is higher than 20%. But this is an arbitrary timeframe since no notable 2009 War on Terrorism event occurred. Thus, those who medically discharged before and after these arbitrary dates, including the 68000 troops STILL in Afghanistan, are not entitled to possible medical retirement under this policy, although they fought during the same war, but at different times. § 1554 of the NDAA for 2008 outlines the oversight and discrimination this petition references.
