Currently the Bureau of Criminal Information and Analysis collects data on each individual for each arrest. They keep this information on record for 100 years. I am petitioning that if a record has been expunged, sealed and destroyed, charges have never been pressed, case has been dismissed or a person has been pardoned, that the arresting information be permanently removed from background checks. Although existing law requires that there be no discrimination based upon expunged or sealed records. These questions are still asked on applications and employers are still discriminating. The 100 year law is causing unemployment increase, student loan debt being unable to be repaid due to employment being denied. No negative information should reflect on a persons record once rehabilitated.
