This petition request is to revoke the ability to waiver military sanctuary and to lower the right to claim sanctuary to sixteen years of total active federal military service, grandfathered September 11, 2001.
Title 10 United States Code (USC), § 12686(a) and 12646(e) establish an active duty (AD) retirement sanctuary for members of Reserve Components (RCs). Currently the member is unable to claim sanctuary until the eighteenth year of total active federal military service.
Reserve commands are requiring members to sign sanctuary waivers starting when a member reaches sixteen years of total active duty military service. RC actively deny members orders for duty to those who don't sign the waiver.
