The Smith Act is a federal statute which sets penalties for the "intent to cause the overthrow or destruction of any such government, prints, publishes, edits, issues, circulates, sells, distributes, or publicly displays any written or printed matter advocating, advising, or teaching the duty, necessity, desirability, or propriety of overthrowing or destroying any government in the United States by force or violence, or attempts to do so."
Penalties range from fines to imprisonment up to 20 years and denial of federal employment for five years following a conviction.
We believe petitioning for secession falls under these terms and citizens who have openly advocated for a breakup of the Union should be charged for these criminal actions.
