Executive action on immigration is a great step to fix the broken immigration system. However, it hasn’t clarified the timeline by when the legal immigration system will be fixed. For instance, un-documented workers will be eligible for EAD after 180 days of the executive action announcement but there is no timeline for legal immigration changes. It will not be just for an un-documented worker to get an EAD before a documented worker, when they have been in US for the same amount of time.

Un-documented worker: Came to US in 2010 and whose children are US citizens. By May 2015 he will be able to get an EAD.
Documented worker from India or China came to US in 2010 and whose children are US citizens. They might have to wait for 5 more years from now to get an EAD.
