The United States is keeping almost 1,000 human beings in jurisdictional limbo through their detention in Guantanamo Bay. This violates in spirit, if not in letter, both the due process clause of the Fourteenth Amendment and the Third and Fourth Geneva conventions regarding the treatment of both civilians and foreign combatants in wartime. This detention must needs vitiate any confidence in whatever statements our nation makes regarding the integrity and resilience of its judicial system.
