On November 20, 2014, Secretary of Homeland Security, Jeh Johnson, issued multiple memoranda regarding deferred action for certain undocumented individuals as well as new immigration policies.
The new policies for enforcement, apprehension, and detention, of noncitizens took effect January 5, 2015. DHS agents including ICE agents have been disregarding the new policies and acting ultra vires to these directives. We request steps to correct this widespread problem.
The directives issued by Secretary of Homeland Security put an affirmative non-discretionary duty on ICE officials to close the removal proceedings of individuals that appear to be eligible for deferred action and refer the case to USCIS for adjudication. We request ICE agents be compelled to perform this ministerial duty.
