Conflicting decision of K1/K2 and IR-2 Visas.

I hired Mr. Paul S. Sonenberg (attorney from the Community Refugee & Immigration Services) to file K-1 and K-2 visas for my Brazilian fiancée (Izabella Cristina Sinicio Ferreira) and our biological daughter (Carolyne Sincio Aguiar) respectively so that they may come to the USA to live with me. My fiancée was granted a visa from Rio de Janeiro American consulate but they denied a visa to my daughter (a minor) based on the reason that she is entitled to the Visa IR2. My attorney disagrees with the consul’s decision. based on Form I-129F (06/13/13 Instructions page 1), Form I-129F, and 9 FAM 502.7-5(B)(3), Classification under INA 101(a)(15)(k)(iii) (child of K1) subsection (a).
