The sale of Kinder Surprise Eggs has been banned in the United States since their introduction in 1973. This ban is based on a law from 1938 that says that a confectionery product with a non-nutritive object, partially or totally embedded within it, cannot be sold within the United States, unless the FDA issues a regulation that the non-nutritive object has functional value. The eggs have been banned in order to protect children while other products are legal in out country that present a far greater risk to children. Kinder eggs remain banned despite reportedly only causing seven deaths since their creation while firearms cause thousands of deaths in the US each year. Parents should be able to protect their children from choking not the government.
