Consider smoking bans in pulbic places that are on private property as unconstitutional.

Smoking bans on private property such as bars and restaurants violate the private property rights of the bar and restaurant owners. A bar or restaurant or other private business is not the government's or the public's property, but the owners private property. They should have the right to choose whether or not to allow smoking in their place of business. If a person does not want to be around smoking, they don't have to go into that bar or restaurant or work there. If a person is offended by the atmosphere of a strip club they wouldn't get a job there. This is government interference and nothing more. The free market will decide whether or not it is profitable for a bar or restaurant to allow smoking or not, but it is not up to the government.
