In April 2013 President Obama in order to stop the escalation of conflict over the Japanese Islands ordered US Cybercom to deploy RPC's (remote procedure calls) in the Chinese People Liberation Army's (PLA) military command and control systems. The Chinese PLA considers this an act of war.
There has never been a public discussion or vote on this war as required by the US Constitution in the US Senate.
Nor has there been a Constitutionally required discussion about the Treaty with the Chinese PLA to keep the war secret.
The Senate needs to discuss whether the US Constitution applies to cyberspace.
