The War Powers Resolution of 1973 has been to court numerous times, and has been the subject of contention since it was passed.
An amendment to the Constitution is proposed, reading:
"The President of the United States shall authorize no military action against another nation, regardless of that nation's recognition by the United States of America, except to respond in a manner consistent with self-defense or protection of national interests after an attack has occurred.
The Congress alone shall declare war.
(a) A failure by Congress to declare war shall limit military use by the President to 31 days.
(b) Congress must take up a resolution for debate within 48 hours after an attack on the country is declared, and all debate shall cease within 96 hours and votes cast.
