There are currently 85 empty appellate court seats, some of which have been vacant for almost a decade. A seat in the Court of Appeals in the Ninth Circuit has been open since the end of 2004. In order to have an effective judicial system, the Obama administration and the senate must take action to appoint and approve justices to fill the vacancies. A court system is useless if there are no courts.
