We would like to encourage the Office of the President to establish a method for reporting failed employment-based drug tests to make those individuals ineligible for unemployment benefits for two years.
Given the significant number of pre-employment based drug tests that are given annually, this can serve as a cost effective way to reduce fraud and abuse of unemployment benefits. Businesses have an incentive to report the failed drug tests, as their tax liability is affected by the costs of the unemployment benefits program. This does not infringe on the privacy of the job applicant, as they have given their consent for an employer to use the results as they see fit.
We feel that this would be best accomplished through an Executive Order or through high level agency coordination.
